This Acceptable Use Policy (the “AUP”) promotes lawful, responsible use of the networks, systems, websites, products and wholesale voice services provided by Tovavo and its service providers (collectively, the “Services”). It forms part of every customer's agreement with Tovavo.
Purpose and scope
This AUP applies to each customer, user, affiliate, agent, contractor, end user and downstream provider that accesses or uses the Services through a Tovavo customer. Its purpose is to protect consumers, customers, Tovavo, other providers and the communications ecosystem from fraud, abuse, unlawful traffic and network harm.
Customers must use the Services in accordance with applicable laws, regulations, industry obligations, contractual requirements and this AUP. A list of prohibited conduct cannot be exhaustive; conduct that creates a material risk to consumers, networks or Tovavo may also violate this AUP.
Customer responsibility
Each customer is responsible for all traffic submitted through its account, including traffic generated by its own customers, end users, vendors and downstream providers. Customers must maintain appropriate controls to know their customers and traffic sources, obtain all legally required consent, keep account and contact information current, and prevent unauthorized use.
Customers may not rely on Tovavo's acceptance or transport of traffic as a determination that the traffic is lawful, consented to, properly authenticated or otherwise compliant.
Prohibited use
The Services may not be used to originate, transmit, facilitate or support:
- Illegal robocalls, unlawful telemarketing, fraudulent schemes, phishing, impersonation, extortion or other deceptive communications.
- Calls made without consent or authorization required by the Telephone Consumer Protection Act, Telemarketing Sales Rule, Do Not Call rules, state law or other applicable requirements.
- False, misleading, invalid or unauthorized caller ID information, including spoofing intended to defraud, cause harm or wrongfully obtain value.
- Harassing, threatening, abusive, hateful, obscene, defamatory or dangerous content, or communications that incite violence.
- Traffic designed to generate artificial revenue, inflate call duration, exploit compensation arrangements or avoid lawful charges.
- Unauthorized access, credential misuse, security scanning, probing, interception, interference or attempts to bypass technical or compliance safeguards.
- Malware, malicious code, denial-of-service activity or conduct that degrades, overloads or disrupts any network, system or service.
- Activity that infringes intellectual property, privacy, publicity or other rights of any person or entity.
- Any effort to conceal a traffic source, evade monitoring, defeat call blocking, circumvent a suspension or misrepresent the nature of a customer or campaign.
Caller identity and authentication
Customers must transmit caller identity information accurately and must have a lawful, verifiable right to use each originating telephone number. Customers may not alter, remove or misuse STIR/SHAKEN identity information or request an attestation level that is unsupported by the customer's relationship to the calling number.
Customers must provide information reasonably requested to validate caller identity, telephone-number authorization, traffic origin, downstream relationships and the basis for any attestation. Caller ID authentication does not replace requirements concerning consent, call content or lawful purpose.
Monitoring and cooperation
Tovavo may review traffic data and account information as reasonably necessary to operate the Services, investigate anomalies, address complaints, reduce fraud, enforce this AUP and comply with legal or industry obligations. Customers must respond fully and promptly to reasonable inquiries, traceback requests and requests to mitigate suspected unlawful traffic.
Customers must preserve relevant records, identify responsible upstream or downstream parties, stop identified unlawful traffic, and describe the corrective action taken. Tovavo may cooperate with law enforcement, regulators, the Industry Traceback Group, other providers and affected parties as permitted or required by law.
Enforcement
When Tovavo reasonably believes that use of the Services violates this AUP or creates an urgent legal, security, consumer-protection or network risk, Tovavo may take proportionate action. This may include warning the customer, requesting information or remediation, blocking calls or destinations, limiting traffic, withholding new routes, suspending Services or terminating the account.
Urgent action may be taken without advance notice when Tovavo believes delay could increase harm or exposure. Enforcement under this AUP is in addition to any rights or remedies available under the customer agreement or applicable law.
Reporting abuse
To report suspected misuse of Tovavo Services, email [email protected]. Include the calling number, called number, date and time with time zone, a description of the issue, and any supporting records available. For account or service support, email [email protected].
Policy changes
Tovavo may update this AUP to reflect changes in the Services, law, regulation, industry practice or risk. The current version will be posted on this page with its effective date. Continued use of the Services after an updated AUP takes effect constitutes acceptance to the extent permitted by the customer agreement and applicable law.
